Welcome to Bilida Media. By using our website or working with us, you agree to the terms outlined below. These terms are here to protect both you (the client) and us (the service provider) so we can focus on what matters—great work and great results.
1. Messaging Consent & Opt-In
By using our services and submitting your contact information, you’re explicitly agreeing to receive text messages and communications from Bilida Media. We capture clear opt-in consent through methods like checkboxes, written confirmation, or text replies. Where required by law or carrier guidelines, we use a double opt-in process—you’ll confirm your number before messages begin.
2. Opt-Out / Unsubscribe Policy
You can opt out of receiving promotional text messages anytime by replying “STOP” or “UNSUBSCRIBE” to any message or following the unsubscribe link provided. We’ll process your request promptly and stop marketing-related messages (though essential service messages may still be sent).
3. Message Frequency & Content
We may send promotional, informational, or transactional messages up to 2 times per week, depending on your preferences and campaign setup. Messages relate to your account, our services, or agreed-upon campaigns. Message and data rates from your carrier apply and are your responsibility.
4. Delivery & Liability Disclaimer
Message delivery depends on your carrier’s network. Bilida Media isn’t responsible for failed, delayed, or filtered messages and is not liable for any loss or damage due to message delivery issues.
5. Data Security & Information Handling
We apply industry-standard security measures to protect your data, but we cannot guarantee complete immunity to risks. You’re responsible for safeguarding your contact info, passwords, and access details.
6. Our Services
Bilida Media offers digital marketing and creative services, including reputation management, paid advertising, website development, and more. The specific services we provide for you will always be clearly defined in a proposal, agreement, or scope of work document.
In order to keep timelines on track and deliver the best possible outcome, we rely on you to:
Provide timely feedback and approvals. Share accurate and complete content, assets, or logins we may need. Confirm that any materials you provide are owned or properly licensed. Delays in communication or missing assets can impact delivery timelines or result in additional costs, which we will always flag early if needed.
8. Payment Terms
All pricing, timelines, and payment details will be clearly outlined in your personalized proposal or agreement. Invoices are due within 7 days of the invoice date. If payment has not been received within 14 days after the due date (i.e., 21 days from the invoice date), a flat late fee starting at $35.00 may apply, depending on the total invoice amount. We will always communicate any fees in advance. Please note that we reserve the right to pause work or withhold deliverables until outstanding payments are settled. Due to the custom nature of our services, refunds are generally not provided. That said, if you ever have concerns about the work, we’re here to talk and find a solution.
9. Ownership & Usage Rights
All work created by Bilida Media remains our intellectual property until full payment is received. Once paid in full, you'll receive a non-exclusive license to use the final deliverables as outlined in your project agreement. Unless otherwise agreed upon in writing, we reserve the right to showcase completed work in our portfolio or promotional materials.
10. Confidentiality
We take confidentiality seriously. Any sensitive information shared with us during a project will be kept secure and not disclosed to third parties without your consent. This confidentiality extends beyond the end of the project.
11. Limitation of Liability
We aim for excellence in every project, but in the unlikely event of an issue, our liability is limited to the total amount paid for the project in question. We are not liable for indirect damages such as lost profits, business interruption, or reputational harm.
12. Termination Policy
Either party may terminate services with 30 days’ written notice, effective after the completion of the agreed-upon minimum contract term (e.g. a three-month commitment). This ensures both sides have adequate time to plan and transition out of the agreement professionally. We also reserve the right to terminate services with the same notice and terms.
If there is a material breach of these Terms and the issue is not resolved within 10 business days of written notice, either party may terminate the agreement immediately. In the event of termination—whether by notice or for cause—all work completed up to the termination date will be invoiced accordingly. If payment was made in advance, a fair breakdown will be provided based on work delivered.
Final deliverables that have been completed and paid for will be transferred to the Client. Drafts, working files, or any materials outside the defined scope may be withheld or archived at the discretion of Bilida Media.
13. Governing Law
These Terms are governed by the laws of Alberta, Canada. Any disputes will be handled in Alberta courts, unless otherwise agreed to in writing.
14. Updates
We may update these Terms occasionally. Any updates will be published on our website, and continued use of our services after changes are posted means you accept those updates.
